But

In view of (7), it seems unlikely that we

shall secure a settlement of this double nationality

question with the Chinese Government at an early date.

Sir M. Lampson and Sir C. Clementi both agree that

we should adopt as a basis of our policy in Malaya

the principle that "A State may not afford diplomatic

protection to one of its nationals against a State

whose nationality such person also possesses".

the interpretation which Malaya has placed on that

principle as set out in paragraph 5 of this despatch

seems to go too far. Surely if an individual in

Malaya, who is of Chinese nationality by race but who

is also a British subject, applies to the Malayan

Government for a British passport to travel abroa

he should receive it, irrespective of whether he is

going to China or not. The Chinese Government

might be within its rights in insisting on a Chinese

visa
